1. The Service
Caska is a cloud-based operations management platform designed for small food and beverage manufacturers. The platform provides tools for order management, production planning, inventory tracking, customer relationship management, and related business operations functionality.
We reserve the right to modify, add, or remove features at any time. We will make reasonable efforts to notify users of significant changes in advance.
2. Accounts and Registration
Eligibility
You must be at least 18 years of age and have the legal authority to enter into binding contracts to use Caska. By registering, you represent that these conditions are met.
Account Responsibilities
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorized access to your account
You may not share your account credentials with others or create accounts on behalf of third parties without their knowledge and consent.
3. Subscription and Billing
Subscription Plans
Caska is offered as a subscription service. Current pricing and plan details are described on our website and within the application. All prices are listed in Canadian dollars unless otherwise stated.
Billing
Subscriptions are billed on a monthly or annual basis, in advance, depending on the plan selected. Your subscription automatically renews at the end of each billing period unless cancelled before the renewal date.
Refunds
We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied within the first 14 days of your first subscription term, contact us at [email protected] for a full refund. After this period, subscription fees are non-refundable, including for unused portions of a billing period.
Failed Payments
If a payment fails, we will notify you and attempt to process the payment again. If the payment remains outstanding after a 5 business day grace period, we reserve the right to suspend or terminate your account.
Price Changes
The rate you subscribe at is the rate you keep — for as long as your subscription remains active and in good standing. We will never raise the price on your existing plan without your consent. That said, we reserve the right to introduce new pricing models, tiers, and plans at any time. Changes to our pricing structure apply only to new subscribers or to users who voluntarily change plans. Cancellation and resubscription at a later date enrolls you at the then-current rate.
4. Acceptable Use
You agree to use Caska only for lawful purposes and in accordance with these Terms. You may not:
- Use the platform to engage in any illegal activity or to facilitate illegal conduct
- Upload or transmit malicious code, viruses, or any software designed to disrupt or damage systems
- Attempt to gain unauthorized access to any part of the platform, its servers, or related systems
- Reverse-engineer, decompile, or attempt to extract the source code of the application
- Use automated means (bots, scrapers, crawlers) to access the platform without prior written consent
- Resell or sublicense access to the platform to third parties without our written permission
- Use the platform in a manner that places unreasonable load on our infrastructure
5. Your Data
Ownership
You retain full ownership of all business data you enter into Caska, including customer records, product information, order history, and any other content you create ("Your Data"). We do not claim ownership of Your Data.
License to Us
By using Caska, you grant us a limited, non-exclusive license to store, process, and display Your Data solely for the purpose of providing the service to you. This license terminates when you delete your data or close your account (subject to the retention terms in our Privacy Policy).
Data Export
You may request an export of Your Data at any time. We will provide exports in a standard, machine-readable format within a reasonable timeframe.
Aggregated Data
We may use anonymized, aggregated, non-personally-identifiable data derived from platform usage to improve the service, understand usage patterns, and inform product development. This data cannot be used to identify you or your business.
6. Intellectual Property
Caska Platform
The Caska platform, including its software, design, user interface, documentation, trademarks, and branding, is owned by 12Strong Ltd. and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the platform.
Your License to Use
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Caska for your internal business purposes during your subscription term.
Feedback
If you provide us with suggestions, feedback, or ideas about the platform, you grant us the right to use that feedback without restriction or compensation to you. We appreciate your input — it genuinely helps us build a better product.
7. Service Availability
We aim to keep Caska available and reliable, but we do not guarantee uninterrupted access. We may occasionally take the service offline for scheduled maintenance (with advance notice where possible) or experience unplanned outages. We are not liable for losses resulting from service unavailability.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASKA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the service will be error-free, secure, or continuously available, or that any specific features will meet your particular business requirements.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASKA AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.
Our total aggregate liability to you for any claims arising out of or related to these Terms or your use of Caska shall not exceed the total amount you paid to us in the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
10. Termination
Cancellation by You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to the platform until that date.
Termination by Us
We reserve the right to suspend or terminate your account if:
- You materially breach these Terms and fail to remedy the breach within 7 days of notice
- Payment obligations remain unfulfilled after a grace period
- Your use of the platform poses a security risk or legal liability
- Required by applicable law
Effect of Termination
Upon termination, your license to use the platform ends immediately. You have 30 days to export Your Data before it is deleted from our systems. Provisions of these Terms that by their nature should survive termination will continue to apply.
11. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice via email or in-app notification before the new Terms take effect. Your continued use of Caska after the effective date of updated Terms constitutes your acceptance of those Terms.
If you do not agree to updated Terms, you may cancel your account before the effective date.
12. Governing Law and Disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of Caska will first be addressed through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to the courts of competent jurisdiction in Alberta, Canada.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
